Employee (Workman)

Who is meant by "Workman"

"Workman" means any person who has entered into or works under a contract with an employer for the purposes of his trade or businesses in any capacity, whether the contract is expressed or implied. Those in apprenticeship too are included.

However a person working in the capacity of a member of the Armed Forces or a member of the Police Force is not included in the definition of 'workman'. Nevertheless those who work in civil capacity in the said forces are deemed as workmen.

Requirements for claiming workman's compensation

  1. An accident should occur.
  2. Such accident should have occurred whilst in the course of employment.
  3. Further, such accident should have arisen out of employment.

Those entitled to compensation

  1. The workman who is injured as a result of the accident
  2. If the accident resulted in the death of the workman, his dependants

Applying for Compensation

A claim using the forms hereinafter provided shall be made by the workman injured in the accident or one of his dependants in the event of the workman’s death, to the Commissioner within two years of the occurrence of the accident.

Form "A" together with a medical certificate of a qualified medical practitioner (Form "S") in a non-fatal accident.

In a fatal accident, form "B" together with death certificate shall be submitted.
